Model Bylaw


The purpose of this model bylaw is to assist municipalities in adopting the Fire Protection Certification Program. For further information on this program please contact ASTTBC.

Being a bylaw for regulating the inspection and testing of fire protection equipment

WHEREAS, the Council of the Municipality/Regional District of may regulate for the protection of persons and property subject to the Fire Services Act and the regulations made under it.

AND WHEREAS pursuant to Section (check with your legal dept) of the Municipal Act may make regulations for the purpose of protecting the public in the carrying on of a business.

NOW THEREFORE the council of the Municipality/Regional District of In open meeting ENACTS AS FOLLOWS:

1. DEFINITIONS

ASTTBC:
means Applied Science Technologists and Technicians of BC which is a self governing, professional association pursuant to the Applied Science Technologists and Technicians Act RS CHAP. 15, 1996.

Acceptable:
means acceptable to ASTTBC and the Authority Having Jurisdiction.

Authority Having Jurisdiction:
means a Local Assistant to the Fire Commissioner and any other person authorized by the municipal council or trustees of a regional district to exercise some or all of a Local Assistant's power.

Fire Protection Equipment:
shall include and mean but not be limited to fire alarm systems, automatic sprinkler systems, special extinguishing systems, portable extinguishers, water supplies for fire protection, standpipe and hose systems, fixed pipe fire suppression systems in commercial kitchen exhaust systems, smoke control measures and emergency power installations (Councils may opt to accept all or a portion of these items).

Fire Protection Technician:
means a person certified by ASTTBC to inspect and test fire protection equipment.
Hotel: Includes:

(a) an apartment house,
(b) a residential condominium building that has:
(i) 2 or more levels of strata lots as defined in the Condominium Act, and
(ii) one or more corridors that are common property as defined in the Condominium Act, and
(c) a boarding house, lodging house, club or any other building, except a private dwelling, where lodging is provided.

Local Assistant to the Fire Commissioner:
means Local Assistant as identified in section 6 of the Fire Services Act.

Public Building:
includes a factory within the meaning of the Workplace Act, a warehouse, store, mill, school, hospital, theatre, public hall, office building and any building other than a private dwelling house.

2.REGULATIONS

2.1 All fire protection equipment in hotels and public buildings within the boundaries of the Municipality/ Regional District shall be inspected and tested by a fire protection technician in accordance with the requirements of the Fire Services Act and the regulations made under it.
2.2. Where a fire protection technician has inspected or tested fire protection equipment pursuant to 2.1 of this bylaw, the fire protection technician shall label the equipment and maintain records in a manner acceptable to ASTTBC and the authority having jurisdiction.
2.3 Where fire protection equipment is labelled pursuant to 2.2 of this bylaw it shall be in a format provided by ASTTBC as shown attached as schedules 1 and 2.

3. OFFENCE

Every person who violates any of the provisions of this bylaw, or who suffers or permits any act or thing to be done in contravention or in violation of any of the provisions of this bylaw, or who neglects to do or refrains from doing anything required to be done by any of the provisions of this bylaw, or who does any act or thing or omits any act or thing thus violating any of the provisions of this bylaw, shall be deemed to have committed an offence, and upon a summary conviction is liable to imprisonment for a term of not more than 6 months or to a fine of not more than 2000.00 dollars or both fine and imprisonment.

4. CITATION

This bylaw may be cited as "Fire Protection Equipment Inspection and Testing " Bylaw No. ________.
